We are delighted you’ve chosen Housie to power your property search and data analysis. These Terms of Use govern your access to and use of our website, mobile applications, and proprietary property data tools. By creating an account, registering via any submission button, or utilizing the platform to access real estate content and data provided by Housie, you acknowledge and agree to be legally bound by these Terms as they may be updated periodically. Your use of the Services signifies your agreement to comply with all applicable laws and regulations regarding your conduct and the security of the data provided.

1. Acceptance, Ownership, And General Terms

1.1. Legal Consent: Your access to or continued use of the Housie website, mobile applications, property search tools, listing displays, agent contact features, saved homes, automated data alerts, research analytics, valuation estimates, and any related software services or data content (collectively, the “Services”) constitutes your binding legal acceptance of these Terms. If you do not agree to these Terms in their entirety, you must immediately cease all access to and use of the Services

1.2. Corporate Identity and Parties: The Services are owned and operated by Housie Inc., a Delaware corporation with its principal place of business at 30 KnightsBridge Rd, Suite 525, Piscataway, NJ 08854 (“Housie,” “we,” “us,” or “our”). In these Terms, “you” and “your” refer to any individual or entity accessing or using the Services, including but not limited to home seekers, property owners, and real estate property managers or facilitators (collectively, "Users").

1.3. Entire Agreement and Amendment Process: These Terms, together with the Housie Privacy Policy and any specific MLS data display rules or platform Listing Guidelines incorporated herein by reference, constitute the entire legal agreement between you and Housie regarding the Services and supersede all prior or contemporaneous communications, negotiations, or understandings. We reserve the right to update or modify these Terms at any time. For modifications deemed material under US consumer protection standards, we will provide you with advance notice via a prominent alert banner on the platform interface or through your registered account email address before the changes take effect. Your continued use of the Services after the designated effective date constitutes explicit, binding acceptance of the revised Terms. If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain fully effective. Section headings are for convenience only and have no contractual significance. Housie may freely assign its rights or transfer its obligations under these Terms at any time without notice to you; you may not assign, sublicense, or transfer your rights, account dashboard access, or contractual obligations under these Terms without our prior written consent. Our failure to enforce any right or provision does not waive our right to enforce it in the future. Sections 1, and 4 through 20 survive any termination of these Terms

2. Eligibility

2.1. Minimum Age and Corporate Authority: To utilize the Services, you must be at least 18 years of age and capable of forming a binding contract under applicable law. By accessing Housie, you represent and warrant that you meet these eligibility requirements. If you are using the Services on behalf of a corporate entity or professional organization, you represent that you have the legal authority to bind that entity to these Terms.

3. User Account and Security

3.1. Registration and Confidentiality: Certain features of the Housie platform require the creation of a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary. You are solely responsible for safeguarding your account credentials, passwords, and API session keys.

3.2. Unauthorized Use and Liability: You accept full responsibility for all activities, data extractions, transactions, and data queries conducted through your account. You agree to notify Housie immediately at security@housie.com upon discovery of any unauthorized access to your account, security breach, or compromise of your credentials. Housie will not be liable for any losses or damages resulting from your failure to safeguard your login credentials.

3.3. Account Sharing and Credentials Transfer Restrictions: Your account is strictly personal to you (or your specific real estate entity, if registered under a corporate tier). You may not sell, transfer, lease, or share your login credentials, passwords, or premium access keys with any third party. Sharing account access to allow unauthorized users or non-subscribed property facilitators to extract listings or utilize our proprietary database analytics constitutes a material violation of these Terms and will result in the immediate suspension or termination of your account. 

3.4. Account Deactivation: You may deactivate your account at any time through your profile settings. Please note that deactivation of an account does not automatically delete data previously submitted to the platform or relieve you of any obligations incurred prior to deactivation. Housie reserves the right to retain certain record-level data as required by law or for legitimate business purposes, such as audit trails and platform security.

4. Scope Of Services And Relationship Disclosure

4.1. Service Overview: Housie provides an integrated suite of real estate tools designed to synthesize vast datasets including property listings, historical tax records, automated valuation metrics, unique property identifiers, and geographic analytics into a single, actionable interface. By utilizing the Services, you are accessing a proprietary database architecture that links public records with real-time market data. You acknowledge that the value of the Services lies in Housie’s unique coordination, technical organization, compilation, and analytical processing of these disparate data sources. 

4.2. Brokerage Status and Agency Limitations: Housie is a licensed real estate brokerage. However, your preliminary use of our automated property search engines, predictive metric widgets, interactive valuation tools, or data dashboards does not establish an attorney-client relationship, a fiduciary relationship, a listing agency, or any formal legal representation between you and Housie Inc. All information provided, including tax projections, investment potential, and property "Housie Scores," is for informational, educational, and property identification purposes only and does not constitute financial, professional, or legal advice.

4.3. Secure Access to Proprietary and Listing Data: To maintain the integrity of the Housie ecosystem and comply with real estate governing bodies, your access to detailed property records is subject to the following professional standards:

  • Consumer Relationship:

    You acknowledge that your use of the platform tools establishes a lawful consumer-broker relationship with Housie for the purpose of your property search.

  • Authorized Use Only:

    You certify that you are accessing this data with a genuine, bona fide interest in buying, selling, or leasing real estate

  • Data Confidentiality:

    The sophisticated data insights, analytics, and listings provided are for your individual, personal use. You agree not to copy, reproduce, export, scrape, redistribute, or repurpose this data for any commercial venture, database, or competing platform.

4.4. Service Limitations: Housie is an information platform and does not originate mortgage loans or insurance products. Any financial tools, estimated monthly payments, or calculators provided are for estimation and educational purposes only and do not represent a commitment to lend or a substitute for a professional appraisal. We reserve the right to modify or restrict access to any feature of the Services to ensure the security of our database and compliance with regulatory standards. 

4.5. Fair Housing Protections and State Mandatory Disclosures:  Housie is deeply committed to the principles of the Federal Fair Housing Act and equal opportunity housing throughout the nation. We strictly encourage, support, and enforce an affirmative advertising and marketing program in which there are no barriers to obtaining housing or real estate information because of race, color, religion, sex, handicap, familial status, or national origin. Pursuant to New York State regulatory mandates, all users interacting with listings in the State of New York are hereby notified of their explicit legal right to fair housing protections. For more detailed information on consumer rights, you may review the official New York Fair Housing Protections Notice distributed by the New York Department of State. Additionally, pursuant to applicable state property laws, real property sellers are legally mandated to execute and deliver a comprehensive Property Condition Disclosure Statement detailing known physical aspects and historic maintenance vectors of the real property prior to binding consumer transactions.

5. Intellectual Property Ownership

5.1. Ownership of the Housie Ecosystem: Housie and its licensors hold all legal rights, titles, and interests in the platform. This encompasses our protected database architecture, underlying source code, front-end designs, algorithms, and all original text or media found within our Services (collectively, our "Content"). This also includes our brand identity, such as the "Housie" name, our logos, and any unique service marks (our "Marks"). These assets are shielded by a combination of US and international laws covering copyrights, trademarks, and trade secrets. Accessing our platform does not transfer any portion of these ownership rights to you. 

5.2.  Proprietary Data and Analytics: While the individual property facts we display—such as square footage or public addresses—are part of the public record, the specific way we curate, structure, coordinate, enhance, and organize this information within our database is protected as an original intellectual ‘work. Furthermore, any data generated by our internal algorithms, including but not limited to "Housie Scores," market trajectory insights, and tax. estimations, remains the exclusive property of Housie.

5.3. Grant of Limited Access: As long as you remain in compliance with these Terms, Housie provides you with a restricted, non-exclusive, non-transferable, and revocable license to navigate and interact with the Services, and to save or print individual portions of our Content for your own personal use. This license is intended solely for private, non-commercial research or internal business evaluation. You may not redistribute, modify, systematically extract, or sync our Content with external databases without our explicit, written authorization.

6. System Integrity and Technical Misuse

6.1. System Integrity and Technical Misuse: By utilizing the Services, you agree and covenant that you will not engage in, facilitate, or assist others with any of the following prohibited behaviors:

  • Deconstruction:

    Reproduce, modify, distribute, decompile, disassemble, or reverse engineer any portion of the Services or its underlying software architecture.

  • Notice Removal:

    Remove or modify any copyright, trademark, or other intellectual property notices contained within the Services.

  • Malicious Software:

    Upload invalid data, viruses, worms, or other harmful software agents to the platform.

  • Security Interference:

    Interfere with or compromise the system integrity or security of the Services, including bypassing "captcha," authentication controls, or other access-restriction measures. 

6.2. Unauthorized Data Extraction and Competition: You are strictly prohibited from conducting the following commercial or data-mining actions:

  • Automated Queries:

    Conducting automated queries (including screen/database scraping, spiders, robots, or crawlers) for the purpose of systematically extracting information, listings, tax histories, user lists, or database schemas from the Services. 

  • Competitive Development:

    Accessing or using the Services to develop, benchmark, promote, or run products or services that compete with Housie.

  • Derivative Works:

    Creating derivative works from or publicly displaying any reviews, ratings, property images, valuation metrics, or listing data on any other website or application without express written permission. 

6.3. Compliance and Ethical Conduct Restrictions: You agree to navigate the platform in accordance with the following regulatory and ethical baselines: 

  • Discrimination:

    Using the Services in any way to discriminate against any individual or class of individuals protected under federal, state, or local laws, or engaging in any activity that promotes discriminatory outcomes or contributes to illegal "steering".

  • Compensation Disclosures:

    Posting, displaying, or communicating any offer of buyer agent compensation (including amounts or percentages) on or through the platform, in accordance with current industry regulatory standards.

  • Unlawful Harm:

    Using the Services in any manner that is unlawful or causes harm to Housie, its service providers, affiliates, or other users.

6.4. Communication and Identification Rules: When interacting with the platform's communication vectors, you agree not to engage in:

  • Impersonation:

    Impersonating any person or entity, misrepresenting your professional affiliation, or engaging in activities under false pretenses.  

  • Spam and Solicitation:

    Distributing unsolicited messages, spam, chain letters, commercial pitches, or pyramid schemes through the platform’s communication and agent contact tools.

  • Inappropriate Content:

     Posting or making accessible content that Housie, in its sole discretion, deems illegal, offensive, harassing, obscene, or disparaging.

  • Trademark Misuse:

     Using any Housie trademarks or brand marks as part of your screen name, email address, or third-party domain name.

6.5. External Linking Restrictions: Providing or authorizing a link to the Services from a third-party website that is not a real estate-related platform owned or operated by a verified real estate or lending professional is strictly prohibited.

7. User-Generated Content License

7.1. Definition and Responsibility: The Services may allow you to post, upload, or otherwise make available content such as photos, videos, property descriptions, reviews, notes, and comments (“User Content”). You retain any ownership rights you hold in your User Content; however, by posting it, you represent and warrant that you own the content or have the necessary legal permissions and third-party consents to share it. You are solely responsible for the accuracy, validity, and legality of all User Content you provide.

7.2. License Grant to Housie: By submitting User Content to the platform, you grant Housie a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, transferable, and sublicensable license to use, host, store, reproduce, modify, adapt, publish, distribute, analyze, and display such content. This license allows us to provide, promote, commercially market, and improve our Services and to develop new tools within the Housie ecosystem. This right continues even if you stop using our Services or deactivate your account.

7.3. Content Standards: You agree that your User Content will not:

  • Violate any third-party rights, including copyright, trademark, privacy, or publicity rights.

  • Contain defamatory, obscene, pornographic, offensive, or harassing material.

  • Violate the Fair Housing Act or any other federal, state, or local anti-discrimination laws.

  • Include "spam," unauthorized advertising, commercial pitches, or links to malicious websites.

7.4. Monitoring, Removal, and Liability: While Housie is not obligated to screen or monitor User Content, we reserve the right, in our sole discretion, to review, flag, or remove any content that we believe violates these Terms, exhibits discriminatory behavior, or is otherwise harmful to the platform. Housie assumes no liability for any User Content posted by you or any third party.

7.5. Feedback and Submissions Assignment: If you provide Housie with suggestions, ideas, or feedback regarding the improvement of the platform (“Submissions” or “Feedback”), you automatically transfer and assign all legal intellectual property rights for those ideas to Housie. You agree that we may use, host, store, share, or monetize such Feedback in any manner for any purpose without providing you with payment, compensation, attribution, or obligation. You warrant that any Submission you provide is your own original work or that you have the legal right to share it, and you agree to indemnify Housie for any legal losses arising from your Submissions.

8. Termination Clause

8.1. Right to Terminate or Suspend Account: Housie reserves all rights not explicitly granted in these Terms. Any unauthorized use of our Content or Marks, or a breach of this intellectual property and prohibited conduct standards, is considered a material violation of our agreement and will result in immediate revocation of your access to the platform. We reserve the right, in our sole discretion and without prior notice or liability to you, to suspend, limit, or terminate your account and block your access to the Services at any time for any reason whatsoever, including actual or suspected violations of these Terms, law enforcement requests, unexpected technical updates, or prolonged inactivity. Upon termination, your right to use the Services, access property metrics, or view saved dashboards will immediately cease.

9. Disclaimers ("AS-IS")

9.1. Provision of Information Without Warranty: THE SERVICES AND ALL HOUSIE CONTENT, PROPERTY LISTINGS, TAX RECORDS, VALUATION ESTIMATES, MARKET INSIGHTS, AND ANALYTICAL TOOLS CONTAINED THEREIN ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOUSIE EXPLICITLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT

9.2. Third-Party Data Reliance and Accuracy: HOUSIE DEPENDS ON PUBLIC TAX DATA, THIRD-PARTY MULTIPLE LISTING SERVICES (MLS), ASSESSOR FILINGS, AND GOVERNMENT RECORDS. WE DO NOT CREATE THIS DATA; WE PROVIDE A PLATFORM FOR DISPLAY AND ANALYSIS. WE DO NOT WARRANT THAT PROPERTY BOUNDARIES, TAX ASSESSMENTS, SQUARE FOOTAGE ESTIMATES, SCHOOL ZONES, OR LISTING STATUSES ARE 100% ACCURATE, COMPLETE, TIMELY, OR ERROR-FREE. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, OR THAT "HOUSIE SCORES" OR PREDICTIVE METRICS WILL BE ACCURATE FOR MAKING FINANCIAL INVESTMENTS. ALL INFORMATION SHOULD BE INDEPENDENTLY REVIEWED AND VERIFIED.

9.3. Non-Endorsement: THE DISPLAY OF A PROPERTY LISTING OR TAX HISTORY RECORD ON HOUSIE DOES NOT IMPLY AN ENDORSEMENT, RECOMMENDATION, OR CO-SIGN OF THE REAL PROPERTY, THE SELLER, OR THE LISTING AGENT BY HOUSIE. 

9.4. Technical and Environmental Limitations: HOUSIE IS NOT RESPONSIBLE FOR ANY TECHNICAL MALFUNCTIONS, SERVER OUTAGES, SECURITY COMPROMISES, OR DATA LOSS CAUSED BY THIRD-PARTY HOSTING PROVIDERS, INTERNET CONNECTIVITY ISSUES, OR USER DEVICE COMPATIBILITY. WE RESERVE THE RIGHT TO PERFORM MAINTENANCE OR UPDATE THE PLATFORM AT ANY TIME, RESULTING IN TEMPORARY SERVICE DISRUPTIONS.

10. Limitation Of Liability

10.1. Exclusion of Incidental and Consequential Damages:: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HOUSIE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA LOSS, INVESTMENT LOSSES, GOODWILL, USE, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICES.

10.2. Liability Cap and Security Breaches: UNDER NO CIRCUMSTANCES WILL HOUSIE BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICES OR YOUR ACCOUNT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOUSIE’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS, LIABILITIES, OBLIGATIONS, OR DAMAGES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO HOUSIE FOR ACCESS TO THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE INCIDENT, OR (B) ONE HUNDRED US DOLLARS ($100.00). 

10.3. Basis of the Bargain: THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN HOUSIE AND YOU. YOU ACKNOWLEDGE THAT HOUSIE WOULD NOT BE ABLE TO PROVIDE THE SERVICES ON AN ECONOMICALLY REASONABLE BASIS WITHOUT SUCH LIMITATIONS. 

10.4. Jurisdictional Rights: SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS AGREEMENT GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

11. Indemnification

11.1.  Duty to Indemnify: You agree to indemnify, defend, and hold harmless Housie, its affiliates, officers, directors, employees, and agents from and against all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of and access to the Services, your violation of any third-party rights, or your violation of these Terms.

11.2. User Content Disputes: This indemnification obligation includes any claims related to User Content or Submissions you provide, including but not limited to claims of copyright infringement, trademark violation, fair housing non-compliance, or defamation. You agree to cooperate fully with Housie in the defense of any such claim.

11.3. Control of Defense: Housie reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us. You agree not to settle any legal claim or matter involving the platform without the prior written consent of Housie.

12. Dispute Resolution And Governing Law

12.1. Governing Law and Jurisdiction: These Terms and any dispute or claim arising out of your relationship with Housie shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within New York County, New York, to resolve any dispute or claim arising from these Terms.

12.2. Informal Negotiations: To expedite resolution and control the cost of any dispute, you and Housie agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating any formal court proceeding. Such informal negotiations commence upon written notice from one party to the other.

12.3. Class Action Waiver: YOU AND HOUSIE AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATION OF ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR HOUSIE WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, A REPRESENTATIVE ACTION, A COLLECTIVE ACTION, OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY. 

13. COPPA Compliance (Children’s Online Privacy)

13.1. Protection of Minors: Housie does not knowingly collect, maintain, or solicit personal information from children under the age of 13. The Services are strictly tailored to real estate professionals, property managers, and adult consumers. If we discover that a child under 13 has bypassed security mechanisms and registered an account, we will immediately delete all associated personal data from our active storage infrastructure.

14. State law Considerations

14.1. California Consumer Rights Notice: Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. 15. DMCA Safe Harbor (Copyright Agent Process) 

15.1.  Notice of Infringement: Housie respects the intellectual property rights of others. If you believe that any content, description, or image hosted on the Services infringes upon your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing our Designated Copyright Agent with the following information in writing:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright. 

  • Clear identification of the copyrighted work claimed to have been infringed.

  • Identification of the material that is claimed to be infringing and its specific URL location on the Services. 

  • Your contact information, including address, telephone number, and email. 

  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner.

  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.

15.3. Counter-Notice: If you believe that your User Content was removed by mistake or misidentification, you may submit a formal counter-notification to our Copyright Agent. Upon receipt of a valid counter-notification, Housie may restore the content in accordance with the DMCA unless the original complaining party files a court action.

15.4. Repeat Infringers Policy: In accordance with the DMCA and other applicable laws, Housie maintains a strict policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users, facilitators, or property managers who are deemed to be repeat infringers.

16. Fees, Payments, And Subscriptions

16.1. Service Fees: While many core features of the Housie platform are currently provided at no cost, we reserve the right to charge fees for premium data access, advanced analytical tools, or other "Pro" features (collectively, "Paid Services"). If you choose to utilize Paid Services, you agree to the pricing and payment terms displayed at the point of purchase.

16.2. The Housie Wallet and Auto-Reload System: To streamline the management of professional services, Housie provides an integrated Wallet feature.

  • Primary Payment Method:

    For users with active subscriptions, the Housie Wallet serves as the primary source for recurring payments. 

  • Auto-Pay and Renewal:

    If you enable Autopay, your subscription will automatically renew at the start of each billing cycle using the funds available in your Wallet.

  • Auto-Reload Logic:

     In the event your Wallet balance is insufficient to cover the total renewal cost, Housie is authorized to automatically deduct the remaining balance from your registered credit or debit card ("Auto-Reload").

  • Failure of Payment::

     If both the Wallet balance and the registered card fail to provide the total amount required for renewal, your subscription will be immediately cancelled at the end of the current billing period. 

16.3. Payment Processing:: All payments are processed through third-party payment gateways. By providing a payment method, you authorize Housie (or our third-party processor) to charge the designated payment method for the total amount of your purchase, including any applicable local taxes. You are responsible for maintaining accurate and up-to-date billing information. 

16.4. Subscription Renewals and Cancellations: If you enroll in a recurring subscription, your membership will automatically renew at the end of each billing cycle unless you cancel it through your account settings before the renewal date. All cancellations will take effect at the end of the current billing period; Housie does not provide partial refunds or credits for unused subscription time. You may cancel your subscription at any time by navigating to the "Account Settings" menu and selecting "Manage Subscription," or by contacting our support team at support@housie.com. To avoid being charged for the next billing cycle, you must initiate the cancellation at least 24 hours before your current period ends. Upon cancellation, you will retain access to Paid Services until the end of your current paid billing period.

16.5. Changes to Pricing: Housie reserves the right to adjust pricing for our Services at any time. Any price changes will be communicated to you in advance and will apply to the next billing cycle following the notice.

17. Communications And Consent

17.1. Operational and Marketing Communications: By creating an account or providing your contact information, you consent to receive electronic communications from Housie. These may include transactional messages such as account verification and security updates, service alerts regarding new property listings or changes to "Housie Scores," and promotional content regarding new platform features and special offers. 

17.2. Text Messaging (SMS) and Push Notifications: If you provide a mobile phone number and opt-in to SMS alerts, you verify that you are the owner of that number and consent to receive text messages from us. You acknowledge that standard message and data rates may apply. You may also opt-in to receive "Push" notifications through the Housie mobile application to stay updated on real-time market changes.

17.3. Opt-Out Procedures: You may opt-out of receiving promotional emails at any time by clicking the "Unsubscribe" link at the bottom of our emails. To stop receiving SMS messages, you may reply "STOP" to any message received. Please note that even if you opt-out of marketing communications, Housie reserves the right to send you essential transactional or administrative messages regarding your account, subscription billing, or critical legal updates. 

17.4.  Recording of Communications: For quality assurance, security, and training purposes, Housie may monitor or record communications between you and our support team, as well as any communications facilitated through our platform tools, such as inquiries sent to real estate professionals or automated data requests. 

18. Third-Party Links And Services

18.1. Third-Party Web Disclaimers: The platform may contain links to third-party websites (such as mortgage calculators, insurance providers, or utility companies). Housie does not control, and is not responsible for, the content, privacy policies, or practices of any third-party websites. Your interactions with these entities are strictly between you and the third party. 

19. General Provisions

19.1. Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Housie regarding your use of the Services and supersede any prior agreements or understandings.

19.2. Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable. 

19.3. No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or condition in one instance does not constitute a waiver of such right or condition in the future.

19.4. Assignment: Housie may assign its rights and obligations under these Terms at any time without notice to you. You may not assign your rights or obligations under these Terms without our prior written consent.

21. MLS Listing Terms Of Use

21.1. Legal Consumer Relationship: You acknowledge that by using the search tools or communicating via the platform, you may be entering into a lawful consumer relationship with Housie or its affiliated real estate professionals where required by regional MLS regulations.

21.2. State Mandatory Disclosures: Required state disclosures apply. Disclosures for the following jurisdictions are available where applicable: Colorado, Idaho, Kansas, Maine, Minnesota, Missouri, North Carolina, Oklahoma, Oregon, South Carolina, Texas, and Vermont.

21.3. Non-Commercial Use Limitation: All property listing data is provided solely for your personal, non-commercial use. You confirm that you have a bona fide interest in the purchase, sale, or lease of real property.

21.4. Scraping Prohibition: You agree not to copy, reproduce, scrape, redistribute, or retransmit MLS data except as strictly necessary to evaluate a specific real property.

21.5. MLS Copyright and Ownership: Each MLS retains ownership and copyright in its respective listing database, and you acknowledge the proprietary rights of those respective MLS providers. 

21.6. Compliance Access: MLS organizations, participants, and authorized regional representatives may access the Services to monitor compliance with MLS data display regulations.
